Tools designed to leverage AI to determine the most likely outcome of a case, which have been dubbed “judge bots” by the American Bar Association, can assist attorneys in charting the best course of action.

In fact, many corporate clients are no longer willing to pay for legal paperwork due to the possibilities of automation. This means that law firms can charge more for experience, consultations, and analysis, while relieving their teams from mundane tasks. It is supposed to be an accumulation of efforts from the universities teaching law, lawyers in practice, judges, and law firms. Artificial Intelligence has the potential to bring about massive innovation and make the system of courtrooms much more effective. Unlike attorneys in law firms, corporate counsel have no incentive to maximize their hours. Indeed, many lawyers go in-house to improve their work-life balance, which includes getting home at a reasonable hour.

Not surprisingly, Gartner, Inc., an American technology research and consulting firm, paints a rosier picture, predicting that AI will create 2.8 million jobs while eliminating only 1.8 million. Statistics such as these are misleading, however, because these do not mean anyone’s current occupation is immune from elimination by AI.

This requires that the creator of the AI collect the legal performance data on various versions of contract language, a process called “labeling.” This labeled data then is used to train the AI about how to generate a good contract. However, the legal performance of a contract is often context-specific, not to mention varying by jurisdiction and an ever-changing body of law. Plus, most contracts are never seen in a courtroom, so their provisions remain untested and private to the parties. AI generative systems training on contracts run the risk of amplifying bad legal work as much as good.
